In a significant move to boost tourism and accommodate digital nomads, Costa Rica has extended the period of stay for tourists from a select group of countries.
The announcement came through Executive Decree 44187 on August 31, 2023. Blue Zone Legal is pleased to provide an overview of this development and its implications for travelers.
The Extended Stay Policy

Under the new policy, tourists from 60 countries, as listed in Executive Decree 36626, now have the opportunity to stay in Costa Rica for up to 180 calendar days. This marks a substantial increase from the previous limit of 90 days. It’s important to note that this extension is not extendable beyond the 180-day period, except in cases where shorter durations have been authorized.

Eligible Countries in the First Group

The countries falling under the first group of entry, and thus benefiting from this extended stay policy, include:

  • Germany
  • Lithuania
  • Andorra
  • Luxembourg
  • Argentina
  • Malta

Driving Provisions

While the extension of stay is a welcome development, it’s crucial to be aware of an important caveat. The validity of foreign driver’s licenses remains set for up to 90 days from the last entry. This means that, in absence of further measures from the Ministry of Transportations, tourists may not be legally allowed to drive in Costa Rica during the second half of their visa period. It is recommended to explore alternative transportation options.

Implementation and Further Information

This new policy is in effect from September 8, 2023. Travelers are encouraged to review the specific entry requirements and procedures at Dirección General de Migración y Extrangería.

The legal document outlining this extension can be found in the official publication DECRETO 44187-MGP Extensión plazo turismo países primer grupo.
